On November 6, 2024, the Superior Court of British Columbia in Bankruptcy and Insolvency (the “Canadian Court”) entered an order (the “Receivership Order”) with respect to Rokstad Holdings Corporation and 9 of its affiliates (collectively, the "Debtors”), commencing a receivership proceeding (the “Canadian Receivership”) under the Bankruptcy and Insolvency Act (the “BIA”). The Canadian Court appointed FTI Consulting Canada Inc. to serve as the Receiver (the “Receiver”) in the Canadian Proceeding and authorized the Receiver to commence chapter 15 proceedings in the United States.  Pursuant to the Receivership Order, the Receiver continues to operate the Debtors’ business in the ordinary course.

 

On November 21, 2024, FTI Consulting Canada Inc., as authorized foreign representative (the “Foreign Representative”), filed a voluntary petition for each of the Debtors under chapter 15 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”). The chapter 15 cases are ancillary proceedings to the Canadian Proceeding, through which the Foreign Representative has asked the Bankruptcy Court to recognize the Canadian Proceeding as the Debtors’ foreign main proceeding and enforce in the United States the relief granted by the Canadian Court in the Canadian Proceeding.

 

The cases are pending before the Honorable Mary F. Walrath and are jointly administered for procedural purposes under Case No. 24-12645. This is the official website for the chapter 15 cases maintained by the Debtors’ U.S. noticing agent.
